Reporting accidents and near misses
This page contains a general description of leisure service providers' obligations under the Consumer Services Act 185/2025. For more detailed instructions, see Tukes instructions Safety in Consumer Services.
The service provider must report the following accidents or near-miss situations to Tukes:
- A serious accident that has resulted in the death or serious injury of the service user or a person directly affected by the service, meaning long-term or permanent health damage. A serious accident is also one where many people are injured or exposed to risk.
- A serious near-miss situation that could have resulted in the death or serious injury of the service user or a person directly affected by the service. A serious near-miss situation can be, for example, the service user being underwater for a long time uncontrollably, falling from a high place without physical injuries, or a racing car driving into the audience at a motorsport event.
- An atypical, unexpected, or unforeseen situation that deviates from the hazards identified by the service provider in advance or from the usual safety situation for the specific service type. This could be, for example, a new or unusual risk factor or risk situation for the specific service or service type, or a new phenomenon or risk behavior observed in the behavior of service users.
The service provider must report immediately and indicate what measures have been taken due to the incident.
If the accident or near-miss situation is not serious, for example, if it is a mild typical accident, the service provider does not need to report it to Tukes. However, such risk situations, accidents, or near-miss situations must be recorded in the service provider's own accident log.
To submit a report, Tukes online reporting form can be used or via email to Tukes Registry ([email protected]). If the report contains secret information, the Encrypted message service must be used.
Tukes records and processes all reports. The need for measures is assessed in each individual case.
