Safety data sheets and chemical notifications to comply with new EU Regulation in December 2012

As of 1 December 2012, the safety data sheets on chemicals must comply with the EU Regulation No 453/2010. As the chemical notifications sent to the Chemical Products Register of the Finnish Safety and Chemicals Agency (Tukes) are based on the safety data sheet, the chemical notifications shall also be revised. In future, Tukes will return to the sender any chemical notifications based on outdated legislation.

The new requirements for the safety data sheet are due to the amendment to Annex II of the REACH Regulation (Commission Regulation (EU) No 453/2010). Entered into force on 20 June 2010, the amendment has been applied as of 1 December 2010. As for chemicals that have been subject to transition periods, the amendments in accordance with the Regulation shall be implemented by 1 December 2012. The transition periods have applied substances placed on the market classified, labelled and packaged prior to 1 December 2010, or mixtures delivered to a recipient at least once before that date.

The amendments related to the CLP Regulation (Regulation (EC) No 1272/2008 of the European Parliament and of the Council) shall also be noticed. Substances that have been subject to the transition period must be classified, labelled and packaged in accordance with the CLP Regulation by 1 December 2012. As for mixtures, the requirements laid down in the CLP Regulation must be complied with by 1 June 2015 (transition period until 1 June 2017). Stated in section 3 of the safety data sheet, the classifications of the ingredients of a mixture shall also comply with the CLP Regulation as soon as the classification data is available.
